Right of Withdrawal

The following notice applies to consumers within the meaning of the Austrian Consumer Protection Act (KSchG) for bookings and orders made via this booking page, which is operated via the bookingbird platform. The contracting party and addressee of any withdrawal is solely the respective provider operating this booking page (see Imprint). bookingbird, as the technical platform operator, is not a contracting party.

1. Right of Withdrawal

Consumers generally have the right to withdraw from a distance contract within 14 days without giving any reason (§ 11 FAGG, the Austrian Distance Selling Act). For services, the period begins on the day the contract is concluded. Sending the withdrawal declaration to the provider before the period expires is sufficient to meet the deadline.

2. Exceptions to the Right of Withdrawal

No right of withdrawal exists in particular in the following cases (§ 18 FAGG):<br/><br/><strong>a) Leisure services with a fixed date (§ 18(1)(10) FAGG):</strong><br/>For services related to leisure activities where the contract provides for a specific date or period — this applies in particular to <strong>tickets for events, courses, and appointments with a fixed date</strong>. Such bookings cannot be withdrawn under the FAGG rules once the contract is concluded.<br/><br/><strong>b) Fully performed services (§ 18(1)(1) FAGG):</strong><br/>Where the provider has fully performed the service before the end of the withdrawal period — at the consumer's express request and after the consumer's confirmation of their knowledge that the right of withdrawal is lost upon full performance.

3. Consequences of Withdrawal

In the event of a valid withdrawal, the provider shall refund all payments made by the consumer without undue delay and no later than 14 days from receipt of the withdrawal declaration. The refund is made using the same means of payment used for the original transaction, unless expressly agreed otherwise. If, at the consumer's request, performance of the service began during the withdrawal period, a proportionate amount is payable for the services rendered up to the withdrawal (§ 16 FAGG).

4. Exercising the Right of Withdrawal

The withdrawal must be declared by an unambiguous statement (e.g. by email or letter) addressed to the provider. Use of the statutory model withdrawal form (Annex I Part B FAGG) is possible but not mandatory. The provider's contact details:

5. Relationship to the Provider's Cancellation Terms

Independently of the statutory right of withdrawal, the provider may grant voluntary cancellation and rebooking options. These are communicated during the booking process and apply in addition to the consumer's statutory rights without limiting them.
