The contracting party for booked services is solely the respective provider operating this booking page (see Imprint). bookingbird, as the technical platform operator, merely provides the infrastructure and is not a contracting party. bookingbird assumes no liability for the services offered through this booking page. Responsibility for compliance with all legal requirements rests solely with the respective provider.

1. Scope of Application
These General Terms and Conditions (hereinafter "GTC") apply to all bookings and orders for services of the respective provider made via the bookingbird platform. By making a booking through the platform, the customer agrees to these GTC. Deviating or supplementary terms of the customer shall not become part of the contract unless the provider expressly agrees to them in writing.
2. Contracting Parties
The contract for the booked services is concluded exclusively between the customer and the respective provider offering their services via the bookingbird platform. bookingbird is solely the operator of the technical platform and provides the infrastructure for booking processing. bookingbird does not at any time become a contracting party to the service agreement concluded between the customer and the provider. All claims arising from the contractual relationship are to be asserted exclusively against the provider.
3. Booking Process
The customer selects the desired service, appointment, and any additional options via the bookingbird platform. The presentation of services on the platform does not constitute a legally binding offer but rather a non-binding invitation for the customer to make a booking. By submitting a booking, the customer makes a binding offer to conclude a service contract with the provider. The contract is formed upon confirmation of the booking by the provider or through the automated booking confirmation. The customer receives a booking confirmation by email to the email address provided. The customer is obliged to verify the accuracy of their information before submitting the booking.
4. Prices and Payment
The prices of the provider displayed on the platform at the time of booking shall apply. All prices include the applicable statutory value-added tax unless expressly stated otherwise. Payment is made through the payment methods configured by the provider and made available on the platform. Where payment processing is handled via the bookingbird platform, bookingbird receives the payment solely as a technical payment processor on behalf of and for the account of the provider. bookingbird is not the payment recipient in the contractual sense. The provider reserves the right to exclude certain payment methods or to establish additional payment terms.
5. Cancellation and Rebooking
The right to cancel or rebook a booking is governed by the respective cancellation terms of the provider. These are brought to the customer's attention during the booking process. The provider independently determines the cancellation and rebooking deadlines, any cancellation fees, and the conditions for free cancellation. bookingbird has no influence on the provider's cancellation terms and assumes no liability for their content. Cancellations and rebookings are to be made through the functions provided on the platform or by directly contacting the provider.
6. Liability
bookingbird is solely the operator of the technical booking platform. Any liability of bookingbird for the quality, availability, legality, or contractual conformity of the services offered by the provider through the platform is excluded. The provider is solely responsible for the proper delivery of the booked services and for the fulfillment of all contractual and statutory obligations towards the customer. bookingbird is not liable for disputes between the customer and the provider. The liability of bookingbird for damages arising from the use of the platform is limited to cases of intent and gross negligence. Liability for slight negligence exists only in the event of a breach of essential contractual obligations (cardinal obligations), whereby liability is limited to the foreseeable, contract-typical damage. The foregoing limitations of liability do not apply to damages resulting from injury to life, body, or health.
7. Warranty
Warranty claims regarding the services rendered exist exclusively between the customer and the provider. bookingbird assumes no warranty for the provider's services. The provider is solely responsible for the fulfillment of any warranty claims. Defects in the service are to be reported directly to the provider. bookingbird endeavors to provide the platform without disruptions but does not guarantee the uninterrupted availability or error-free operation of the platform.
8. Data Protection
The processing of personal data in connection with the use of the bookingbird platform is carried out in accordance with applicable data protection regulations, in particular the European General Data Protection Regulation (GDPR) and the Austrian Data Protection Act (DSG). Further information on data processing can be found in the provider's privacy policy as well as bookingbird's privacy policy, which are accessible via the platform.
9. Participant Feature
The platform may provide a participant feature that allows registered users to add additional persons to a booking. Where this feature is enabled by the provider, registered users may be searched by other signed-in registered users of the same provider by their first and last name and added as participants to bookings. By registering, the user agrees that their first and last name and their profile picture may be visible to other registered users in the context of this search function, where this feature has been enabled by the provider; the email address, phone number and postal address are not shown. Use of this feature is limited exclusively to the booking process. Any other use of data obtained through the participant search is not permitted.
10. Final Provisions
Should any provision of these GTC be or become wholly or partially invalid, the validity of the remaining provisions shall not be affected. The invalid provision shall be replaced by a provision that most closely reflects its economic purpose. Austrian law shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG) and the conflict-of-law rules of private international law. For consumers within the meaning of the Austrian Consumer Protection Act (KSchG), the mandatory provisions of their respective country of residence shall apply insofar as they provide greater protection. The place of jurisdiction for all disputes arising from or in connection with these GTC shall be, to the extent legally permissible, the registered seat of bookingbird in Austria. For consumers, the statutory place of jurisdiction shall apply.
