Widerrufsbelehrung

Die nachfolgende Belehrung gilt für Verbraucher im Sinne des Konsumentenschutzgesetzes (KSchG) bei Buchungen und Bestellungen über diese Buchungsseite, die über die Plattform bookingbird betrieben wird. Vertragspartner und Adressat eines Widerrufs ist ausschließlich der jeweilige Anbieter, der diese Buchungsseite betreibt (siehe Impressum). bookingbird ist als technischer Plattformbetreiber nicht Vertragspartei.

1. Widerrufsrecht

Verbraucher haben grundsätzlich das Recht, einen im Fernabsatz geschlossenen Vertrag binnen 14 Tagen ohne Angabe von Gründen zu widerrufen (§ 11 FAGG). Die Frist beginnt bei Dienstleistungen mit dem Tag des Vertragsabschlusses. Zur Wahrung der Frist genügt die rechtzeitige Absendung der Widerrufserklärung an den Anbieter.

2. Ausnahmen vom Widerrufsrecht

Kein Widerrufsrecht besteht insbesondere in folgenden Fällen (§ 18 FAGG):

a) Freizeitdienstleistungen mit festem Termin (§ 18 Abs. 1 Z 10 FAGG):
Für Dienstleistungen im Zusammenhang mit Freizeitbetätigungen, wenn der Vertrag einen bestimmten Zeitpunkt oder Zeitraum vorsieht — das betrifft insbesondere Tickets für Veranstaltungen, Kurse und Termine mit festgelegtem Datum. Solche Buchungen können nach Vertragsabschluss nicht nach den Regeln des FAGG widerrufen werden.

b) Vollständig erbrachte Dienstleistungen (§ 18 Abs. 1 Z 1 FAGG):
Wenn der Anbieter die Dienstleistung — auf ausdrücklichen Wunsch des Verbrauchers sowie nach dessen Bestätigung der Kenntnis vom Verlust des Widerrufsrechts — vor Ablauf der Widerrufsfrist vollständig erbracht hat.

3. Folgen des Widerrufs

Im Fall eines wirksamen Widerrufs erstattet der Anbieter alle vom Verbraucher geleisteten Zahlungen unverzüglich, spätestens binnen 14 Tagen ab Zugang der Widerrufserklärung. Für die Rückzahlung wird dasselbe Zahlungsmittel verwendet, das bei der ursprünglichen Transaktion eingesetzt wurde, sofern nicht ausdrücklich etwas anderes vereinbart ist. Wurde mit der Ausführung der Dienstleistung während der Widerrufsfrist auf Wunsch des Verbrauchers bereits begonnen, ist ein anteiliges Entgelt für die bis zum Widerruf erbrachten Leistungen zu zahlen (§ 16 FAGG).

4. Ausübung des Widerrufs

Der Widerruf ist durch eine eindeutige Erklärung (z. B. per E-Mail oder Brief) gegenüber dem Anbieter zu erklären. Die Verwendung des gesetzlichen Muster-Widerrufsformulars (Anhang I Teil B FAGG) ist möglich, aber nicht verpflichtend. Die Kontaktdaten des Anbieters:

5. Verhältnis zu den Stornobedingungen des Anbieters

Unabhängig vom gesetzlichen Widerrufsrecht kann der Anbieter freiwillige Stornierungs- und Umbuchungsmöglichkeiten einräumen. Diese werden im Rahmen des Buchungsvorgangs mitgeteilt und gelten zusätzlich zu den gesetzlichen Rechten des Verbrauchers, schränken diese aber nicht ein.

The following notice applies to consumers within the meaning of the Austrian Consumer Protection Act (KSchG) for bookings and orders made via this booking page, which is operated via the bookingbird platform. The contracting party and addressee of any withdrawal is solely the respective provider operating this booking page (see Imprint). bookingbird, as the technical platform operator, is not a contracting party.

1. Right of Withdrawal

Consumers generally have the right to withdraw from a distance contract within 14 days without giving any reason (§ 11 FAGG, the Austrian Distance Selling Act). For services, the period begins on the day the contract is concluded. Sending the withdrawal declaration to the provider before the period expires is sufficient to meet the deadline.

2. Exceptions to the Right of Withdrawal

No right of withdrawal exists in particular in the following cases (§ 18 FAGG):

a) Leisure services with a fixed date (§ 18(1)(10) FAGG):
For services related to leisure activities where the contract provides for a specific date or period — this applies in particular to tickets for events, courses, and appointments with a fixed date. Such bookings cannot be withdrawn under the FAGG rules once the contract is concluded.

b) Fully performed services (§ 18(1)(1) FAGG):
Where the provider has fully performed the service before the end of the withdrawal period — at the consumer's express request and after the consumer's confirmation of their knowledge that the right of withdrawal is lost upon full performance.

3. Consequences of Withdrawal

In the event of a valid withdrawal, the provider shall refund all payments made by the consumer without undue delay and no later than 14 days from receipt of the withdrawal declaration. The refund is made using the same means of payment used for the original transaction, unless expressly agreed otherwise. If, at the consumer's request, performance of the service began during the withdrawal period, a proportionate amount is payable for the services rendered up to the withdrawal (§ 16 FAGG).

4. Exercising the Right of Withdrawal

The withdrawal must be declared by an unambiguous statement (e.g. by email or letter) addressed to the provider. Use of the statutory model withdrawal form (Annex I Part B FAGG) is possible but not mandatory. The provider's contact details:

5. Relationship to the Provider's Cancellation Terms

Independently of the statutory right of withdrawal, the provider may grant voluntary cancellation and rebooking options. These are communicated during the booking process and apply in addition to the consumer's statutory rights without limiting them.
